Court Throws Out Governor Wavinya’s Bid to Revoke Bail for Blogger Accused of Publishing False Information

The Mavoko Law Courts have dismissed an application filed by Machakos Governor Wavinya Ndeti seeking to have the bail of a man accused of publishing false information about her revoked.

In a ruling delivered on Tuesday, Senior Principal Magistrate Derrick Kuto said the application lacked merit and upheld the earlier bond terms granted to Felix Mambo Nduli, the accused.

Nduli was released on a Sh200,000 cash bail by Chief Magistrate Barbara Ojoo on November 4, 2024, after denying charges of publishing false information contrary to Section 23 of the Computer Misuse and Cybercrimes Act No. 5 of 2018.

Governor Wavinya, who is the complainant in the case, had on June 30, 2025, sought to have Nduli’s bail or bond cancelled, alleging that he had violated court terms prohibiting him from making further defamatory or false social media posts concerning her.

However, in his ruling, Magistrate Kuto said the request failed to demonstrate sufficient grounds to justify revoking the bail.

“This ruling relates to the notice of motion dated June 30, 2025, brought by the complainant against the accused person,” stated Kuto. “Prayer one is spent. Prayer two, seeking revocation of bail or bond, lacks merit as no adequate proof has been presented to show that the accused breached the bail conditions.”

The case against Nduli will proceed under the original bond terms issued in 2024.
