Senate Orders Arrest Of Governor Kihika Over Failure To Honour Summons

Nakuru Governor Susan Kihika is set to be arrested and compelled to appear before the Senate Standing Committee on National Security, Defence and Foreign Relations after senators resolved to invoke enforcement measures over her repeated failure to honour committee summons.

The decision was reached during a committee sitting held on Monday and chaired by Isiolo Senator Fatuma Dullo, with members expressing concern over Governor Kihika’s continued absence despite several invitations and an official summons.

Senator Dullo said the governor had failed to appear before the committee on multiple occasions, prompting members to take steps aimed at compelling her attendance.

Governor Kihika is among key stakeholders expected to provide submissions during the committee’s inquiry into a petition concerning the alleged forced disappearances of young fishermen at Lake Nakuru National Park. However, the governor has not attended any of the committee proceedings related to the matter.

In a separate resolution, the committee ordered fresh sampling and testing of fish from Lake Nakuru after petitioners rejected a report submitted by the Kenya Fisheries Service.

The petitioners argued that the sampling exercise had been conducted solely by the Kenya Fisheries Service and the Kenya Wildlife Service (KWS), contrary to earlier committee directives requiring the participation of all stakeholders.

To enhance transparency and restore public confidence, the committee directed that the exercise be repeated in the presence of committee members, petitioners and other relevant stakeholders.

The senators further resolved to summon officials from the Ministries of Tourism and Wildlife, Agriculture, and Interior to address issues arising from the petition before the committee prepares its final report.

Later, the committee met Prime Cabinet Secretary Musalia Mudavadi and National Treasury Cabinet Secretary John Mbadi to deliberate on concerns surrounding the degazettement of Capitol Hill Police Station.

During the meeting, Mudavadi maintained that due process had been followed in the degazettement and subsequent transfer of the land, stating that the exercise was guided by Cabinet approval on the subdivision of the property.

According to submissions presented to the committee, the African Trade Insurance Agency was allocated two acres of the land, while the Financial Sector Regulators received an additional two acres. St John Ambulance was allocated one acre.

Mudavadi defended the allocations, noting that the African Trade Insurance Agency intends to establish its headquarters on the site to strengthen investment insurance capacity across Africa, particularly in Kenya, which remains the agency’s largest shareholder.

He further explained that the Financial Sector Regulators would use their allocation to establish a consolidated headquarters in line with Cabinet approval issued in 2023, while the allocation to St John Ambulance implemented an earlier Cabinet decision made in 2021.

Committee members present during the sittings included Senators Fatuma Dullo (Isiolo), Lelegwe Ltumbesi (Samburu), Abdul Haji (Garissa), Okong’o Mogeni (Nyamira), Edwin Sifuna (Nairobi) and Joseph Githuku (Lamu). Bomet Senator Wakili Hillary Sigei attended as a friend of the committee
