Senate Halts Impeachment of Nyamira Governor Nyaribo Over Legal Irregularities

Nyamira Governor Amos Kimwomi Nyaribo has successfully halted impeachment proceedings against him after the Senate upheld a preliminary objection raised by his legal team.

In Wednesday’s sitting, 38 Senators voted in favour of the motion to uphold the objection, while only four opposed it, effectively preventing the case from proceeding to a full hearing.

At the outset of the session, Governor Nyaribo’s lawyers raised two key objections, arguing that the impeachment motion dated 11 November 2025 failed to meet the constitutional and statutory requirements for removal from office. Counsel maintained that the purported resolution was invalid and incompetent, citing non-compliance with Article 181 of the Constitution and Section 33 of the County Governments Act.

The Governor’s team, led by Mr Elias Mutuma, also challenged the use of proxy voting, describing it as illegal, alien to the law, and null and void. They contended that the vote count presented by the County Assembly was flawed, pointing out that only 19 Members of the Assembly were physically present during the vote, yet 23 votes in favour of impeachment were recorded. The legal team described this as “numerically impossible, improper and fraudulent.”

Further, the team criticised the Assembly’s position that existing vacancies reduced the membership from 35 to 32, calling the argument legally unsound and illogical.

Representing the County Assembly, counsel argued that proxy voting had been conducted appropriately, supported by proxy letters, and that the Speaker had acted within his discretion under Standing Order No. 1, even though proxy voting is not explicitly provided for in the Assembly’s standing orders.

Before the vote, Senators delivered varied submissions, with many emphasising the need to safeguard justice for the Governor, the Assembly, and the people of Nyamira County.
